SAN ANTONIO, Texas — A deputy with the Bexar County Fire Marshal’s Office is off the job after San Antonio police arrested him overnight Friday on a charge of driving while intoxicated with an open container in the vehicle.
The office identified the deputy as Deputy Fire Marshal Brett Boswell. Officers with the San Antonio Police Department made the arrest during the early hours of Oct. 23, and the charge is a Class B misdemeanor, the fire marshal’s office said in a statement released Friday.
Boswell was suspended right away. He will stay off duty while two reviews run side by side: an internal administrative investigation by the fire marshal’s office and the criminal case, which the San Antonio Police Department is handling. The office said he has worked there for close to two years and ten months. No court date had been made public as of Saturday.
Deputies in the county’s fire investigations unit hold real police powers. All of them are sworn and commissioned peace officers in Texas, with full authority to arrest, search and seize, and they specialize in tracking down the cause of fires and explosions and building criminal cases around them. Each field investigator carries roughly 70 cases a year, and the unit keeps someone on call around the clock every day of the year.
The arrest comes during a busy stretch for the agency. A 90-day burn ban is in effect across unincorporated Bexar County, where the fire marshal’s office enforces the fire code, and anyone caught burning there can be cited for a Class C misdemeanor.
